Frequently Asked Immigration Questions

1. How long does it take to convert the conditional EB-5 green card to a permanent one?
You normally file Form I-829 within the 90-day window before the two-year conditional period ends; once approved, you receive a permanent green card.
2. What is the timeline and process for L-1A or EB-1C executives to obtain a green card?
After holding L-1A status and meeting the one-year overseas and U.S. managerial requirements, you may file EB-1C. With an approved I-140 and little or no backlog, a permanent green card can be issued in roughly 1–2 years.
3. How do I prove the lawful source of investment or operating funds?
Submit bank statements, tax returns, audited financials, asset-transfer documents, and related evidence so every dollar is fully traceable and compliant.
4. Which family members can accompany the principal applicant, and how is a child’s age calculated?
EB-5 and L-1A → EB-1C allow a spouse and unmarried children under 21; under the Child Status Protection Act, a child’s age is reduced by the time the I-526 or I-140 was pending.
5. Can I file EB-5 and L-1/EB-1C petitions simultaneously to gain priority advantages?
Yes. Parallel filings are allowed as long as each petition independently meets its criteria; once one path is approved and you immigrate, the others may be withdrawn.
6. May I legally work or run a business in the U.S. while waiting for processing or a visa number?
EB-5 applicants may stay under another valid non-immigrant status (e.g., F-1, H-1B) and work if authorized; L-1A/EB-1C applicants may work for the U.S. subsidiary while maintaining L-1 status.
